ADA Protects Caregivers The Equal Employment Opportunity Commission (EEOC) receives only about 200 complaints a year from employees alleging caregiver discrimination or about 1% of all Americans With Disabilities (ADA) complaints. This number is expected to increase since the number of caregivers is expected to increase by 9% by 2007. The ADA bars bias against employees simply because they are associated with a disabled person – as a caregiver, family member or friend. This little known part of the law aims to prevent employers from automatically assuming that a caregiver is going to be absent a lot, or can’t be counted on to work a full day, or will be less productive because of their responsibilities as a caregiver.
